Saylor Proposes ‘Digital Bill of Rights’ for Bitcoin and Digital Assets

Michael Saylor, Strategy’s executive chairman, published a policy framework on September 26 titled “Policy Recommendations for Digital Economy Prosperity,” calling for what he terms a “Digital Bill of Rights” for digital assets. The proposal grew out of his September 22 fireside chat at the Bitcoin Policy Institute’s Freedom Tech DC summit, and he previewed it in a September 24 X post: “the age of Digital Assets and Digital Intelligence needs a bill of digital rights.”

    What happened

Saylor lays out five fundamental rights for individuals and companies: to create, issue, custody, transfer, and use digital assets. Key planks of his framework:

    • Bitcoin as “digital capital”: banks should be allowed to custody Bitcoin and offer credit against it — including Bitcoin-backed mortgages — under clear rules, and insurers should get a viable path to hold it on balance sheets and in product designs.
    • Basel rethink: he calls the 1,250% risk weight the Basel framework applies to certain crypto exposures excessively harsh, and wants treatment differentiated between client custody, Bitcoin-collateralized lending, and banks’ own holdings.
    • Digital dollars: banks, fintechs, and tech platforms should have a clear path to issue digital dollar products and compete on yields.
    • Tokenization: holders of tokenized securities should have rights to direct custody, free transfer, and choice of custody/credit providers — not just blockchain copies of legacy settlement.
    • Privacy: ordinary legitimate transactions under $10,000 should not trigger routine government reporting simply because value moved digitally.
    • Capital formation: simpler issuance rules and proportional disclosure so up to 10 million new companies can raise money via tokens; he projects the industry could eventually reach $100 trillion.

    Why it matters

With the CLARITY Act failing to advance in the Senate on September 15, Saylor’s framework sketches what the regulatory route — SEC, CFTC, Treasury, banking regulators, and the White House — could look like instead of new legislation. For investors, the bank-custody plank is the most practical: if Bitcoin becomes acceptable bank collateral, holders could borrow against it without selling, widening mainstream adoption.

The proposal also aligns with the ongoing tokenized-stocks push that Bull Lounge has been tracking.

    What to watch

    • SEC Regulation Crypto Assets: public comments are due October 20, 2026.
    • CFTC staff work on a market-structure regime under Chair Michael Selig, plus the GENIUS Act stablecoin reserve/capital rules.
    • Whether banking regulators revisit the Basel crypto capital treatment.
    • SEC Chairman Paul Atkins’ stance on the tokenization exemption and whether Congress makes any lame-duck attempt at CLARITY.
