    What happened

SEC Commissioner Hester Peirce announced her resignation on September 25, 2026, posting her resignation letter on X with the caption “T minus 7”. Her final day at the agency is October 2.

Known as “Crypto Mom”, Peirce has served on the commission since January 2018 and has led its Crypto Task Force since February 2025. She will join Regent University School of Law as an associate professor in November.

    Key facts:

    • Her departure leaves the SEC with just two sitting commissioners — Chairman Paul Atkins and Commissioner Mark Uyeda.
    • No successor has been named, and confirmation typically takes six to twelve months.

    Why it matters

Peirce was the agency’s most vocal advocate for workable crypto rules, and her exit lands at the worst possible moment for pending rulemaking. The Regulation Crypto Assets proposal — with public comments due October 20, 2026 — now moves forward without its chief internal champion, raising the odds it stalls, gets watered down, or dies after the comment period.

Tokenized-securities exemptions face the same drag. Without Peirce pushing, the path of least resistance for a bare-quorum commission is delay — and delay invites litigation, since industry groups are far more likely to sue over rules written without the Crypto Task Force’s guiding hand.

    What to watch

Watch for a bare quorum becoming no quorum: one more departure or recusal freezes rulemaking across the board. The White House has named no successor — and with confirmation typically taking six to twelve months, that seat could sit empty deep into 2027. Also watch whether the October 20 comment deadline for Regulation Crypto Assets gets extended as staff regroup.
